GROW Nebraska and Member desire that GROW Nebraska sell goods/identified merchandise on behalf of Member pursuant to this consignment agreement, the terms of which are set forth below.
Members need to sign this form before going on any online platforms or in Buy Nebraska Store
Statement of Agreement The parties here to agree as follows: 1. GROW Nebraska agrees to display the agreed upon item(s) in the business. 2. Your item(s) will be market tested for 90 days in the Buy Nebraska Store. If sales are slow a GROW Nebraska team member will set up a product review with business owner. It is critical that everything that is for sale in the Buy Nebraska retail store is also online at BuyNebraska.com. GROW Nebraska online sales on average have gone up 21% a year. If no sales have been generated in 120 days, a meeting will be set up to discuss what changes need to be made. 3. GROW Nebraska and Member agrees to the following: Member will provide GROW Nebraska with their wholesale price and suggested retail price so that a pricing analysis can be completed. GROW Nebraska pays members monthly on a commission basis. Members will agree to the price GROW Nebraska will pay for each item. Generally, the payout GROW Nebraska provides is up to 60% of the retail price. If GROW Nebraska sells over $5,000 a year of a member’s product, the member can then select to be paid wholesale, net 30 days. - Very important: Member should provide an accurate packing list or invoice for all product delivered to the Buy Nebraska store at the time of delivery. GROW Nebraska staff will provide receiving receipt via email when product has been received into the point of sale. In addition, GROW Nebraska does not like to hold members inventory (money). Therefore, a limited amount of inventory will be kept at the store. If online sales become brisk, members will be asked to drop ship until more inventory can be delivered to the Buy Nebraska Store. GROW Nebraska’s goal is to turn your product within 90 days. -It is highly recommended that the member sends GROW Nebraska a monthly statement for all drop shipment product sold on GROW Nebraska online platforms. Statements will be compared to GROW Nebraska's records prior to sending vendor checks. This will ensure the correct information has been received. 4. GROW Nebraska agrees to sell merchandise that is in agreed upon condition. Please do not be offended if some items are not accepted for sale. Member agrees to market testing for products that are new, need evaluation, or need action plan to identify sale obstacles/customer feedback. GROW Nebraska reserves the right to remove products from retail store that receive considerable feedback. GROW Nebraska will communicate issues and opportunities to Member. 5. Member not renewing GROW membership will be required to pick up merchandise within 30 days of renewal month cancellation. Merchandise not picked up will be donated to the GROW Nebraska Foundation and eligible for resell in retail store. 6. Merchandise is left with GROW Nebraska at Member’s risk. a. GROW Nebraska IS NOT liable for loss of consigned articles through FIRE, THEFT, VANDALISM, NATURAL DISASTERS, OR IN-STORE DAMAGE. Member warrants to GROW Nebraska that the merchandise consigned pursuant to this agreement are not in violation of any trademark, copyright, other proprietary right of third parties or that merchandise is stolen goods from other parties. Member will provide any written documentation/proof of trademark/licensing as requested by GROW Nebraska. 7. GROW Nebraska is not requiring business liability insurance for our art and craft business members. However, we do recommend you consult with an insurance professional about loss of product and business activities business liability insurance. Most art and craft fairs are starting to require business liability insurance. Protecting your business interest is very important.

Bath and Body Vender
All handmade soap and body products are professionally made and must go through a product evaluation process to become part of the GROW Nebraska Program. Every ingredient must be listed on the package so the customer can avoid using any soap or lotion if they are allergic to an ingredient listed. On all product labels it must state, 'Discontinue Use If Irritation Occurs'. Please verify that your product meets the below requirements. • The bases are made by manufacturers that meet FDA standards. • Colorants and fragrances are formulated to be safe for use on skin. • Any toys in children’s toy soaps are specifically chosen to not a be a choking hazard. • All utensils used in the manufacturing of products are cleaned separately, and are used fresh from the dishwasher. • Soaps are immediately wrapped to avoid any contamination. • All surface area to be used during the soap making process is cleaned, disinfected prior to process.

Food Vendor
The sale of food is regulated by the federal government and most state governments. Sellers who list food and food-related products should familiarize themselves with these laws before joining GROW Nebraska. Prior to becoming a food member of GROW Nebraska and you have any question if your products qualifies, please contact GROW Nebraska's Food/Beverage Mentor, Cheryl Hughes of HR Poppin Snacks at [email protected]. Prohibited Food Items: For the safety of GROW Nebraska members, sellers may not list the following food and food-related items on the GROW Nebraska website or any printed/marketing opportunities: • Listings containing drug claims-that is, a claim that the item is intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans and/or animals (for example, pharmaceutical drugs, contact lenses, misbranded dietary supplements). • Non-pasteurized dairy products. • Fruit and vegetable juice products that have not been heat pasteurized. • Wild mushrooms. • Expired military MREs (meals ready-to-eat), unless the MRE is considered a collectible item and is not intended for consumption (and the listing states the MRE is not intended for consumption). • Perishable items: Sellers who list perishable items should clearly identify in the item description the steps that they will take to ensure that the goods are delivered to the buyer safely. For example, sellers of perishable goods should offer overnight delivery and ensure that the goods are properly packaged. • Sealed Containers: All food and related products sold by GROW Nebraska should be packaged or sealed to ensure that the buyer can identify evidence of possible tampering. • Expiration dates: All items must be clearly marked expiration, "use by" date or born-on date. There are many federal and state laws that sellers must comply with when selling food through GROW Nebraska. Some examples are: • Ingredients: There are federal and state laws that require labels to state, among other things, the food's ingredients, nutrition information, and place of manufacture. • Food Licenses: Nebraska Food Processing Permit from the State Department of Ag, Bureau of Dairies and Foods and Nebraska State Sales Tax Permit. • Insurance: At least $1,000,000 (one Million) of liability insurance. • Import/Export: There are restrictions on the import and export of many food products. • FDA Bioterrorism Registraton: If you are producing your food yourself, you must be registered with the FDA in regards to bioterrorism. To submit the forms needed please visit www.access.fda.gov. If you have issues you can call 800-216-7331 from 7:30am to 11pm Monday through Friday and they will walk you through the whole process. You will be able to print out your registration right away. If you are utilizing a co-packer you will need to have you co-packer's registration on file. Please contact your co-packer for more information.

If a dispute between the member and GROW Nebraska occurs, both agree to negotiate in good faith, with professionalism and maturity. If negotiation is not successful, the dispute will be mediated.
